These Terms and Conditions govern the provision of all event management, mobile casino, team-building, and interactive entertainment services delivered by "AWE" Piotr Janaska (acting via the authorized representative Sandra Pająk) to corporate and private clients across Poland.

By submitting a booking inquiry, confirming an offer, or otherwise engaging our services for on-location events, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions.

1. Terms and Conditions Overview

1.1. The purpose of these Terms and Conditions is to clearly define the legal framework governing cooperation between "AWE" Piotr Janaska and its clients in relation to the planning, organization, and execution of on-location events throughout Poland.

1.2. These terms apply to all services offered through the website eveningfestive.com, including but not limited to mobile casino entertainment (Poker, Roulette, Blackjack), themed team-building galas, and interactive entertainment programs held at the client’s chosen venue.

1.3. The Terms and Conditions form an integral part of any proposal, quotation, email confirmation, or written agreement concluded between "AWE" Piotr Janaska and the client, unless expressly agreed otherwise in writing.

2. Acceptance of Terms

2.1. By requesting a quote, confirming a booking, signing an agreement, or allowing us to commence preparatory work related to your event, you agree to be legally bound by these Terms and Conditions in their latest version available at the time of confirmation.

2.2. If you act on behalf of a company, association, institution, or other organization, you confirm that you are duly authorized to represent that entity and bind it to these Terms and Conditions.

2.3. Any deviations from these terms are only valid if expressly agreed in writing by "AWE" Piotr Janaska via the authorized representative Sandra Pająk. Verbal assurances or side agreements are not binding unless subsequently confirmed in writing.

3. Service Scope & Delivery

3.1. "AWE" Piotr Janaska specializes in premium, on-location event management, focusing strictly on mobile casino experiences (including Poker, Roulette, Blackjack), themed team-building galas, and interactive entertainment programs organized at the client’s chosen venue anywhere within the territory of Poland.

3.2. The detailed scope of each event (such as formats, number of gaming tables, number of staff members, duration, technical requirements, and supporting activities) is specified individually in the proposal, quotation, or booking confirmation shared with the client.

3.3. Service delivery is subject to technical, logistical, and legal feasibility at the proposed venue. This includes, but is not limited to, sufficient space, safe access, power supply, noise regulations, and any venue-specific rules. "AWE" Piotr Janaska reserves the right to adapt or limit the service scope if local or legal conditions make specific elements impractical or unsafe, while informing the client without undue delay.

3.4. The company does not provide permanent fixed-location casino operations. All entertainment formats are delivered exclusively as temporary, mobile, and recreational experiences without real-money gambling for the public, and in compliance with applicable Polish regulations.

3.5. Unless otherwise agreed in writing, "AWE" Piotr Janaska is responsible for the professional performance and coordination of the agreed event services, but not for the general management of the venue, external catering, or services outsourced and contracted directly by the client.

4. Booking and Confirmation

4.1. Booking inquiries can be submitted via the website, particularly through the Booking or Contact Us pages, by email to [email protected], or through other communication channels explicitly indicated by "AWE" Piotr Janaska.

4.2. A booking becomes provisionally reserved once the client receives a written offer outlining the proposed concept, scope, date, location, and indicative pricing. Provisional reservations do not guarantee availability until the booking is formally confirmed.

4.3. A booking is considered confirmed and binding when the client: (a) provides written acceptance of the offer (e.g., email confirmation or signed agreement); and (b) pays the agreed advance payment or deposit, if such a requirement is stated in the offer or invoice.

4.4. "AWE" Piotr Janaska reserves the right to withdraw or modify an offer prior to confirmation if the event date has been taken by another confirmed client, or if relevant circumstances significantly change. In such cases, the client will be notified as soon as reasonably possible.

4.5. Any changes requested by the client after confirmation (e.g., changes to the date, time, venue, or event scope) are subject to availability, written acceptance by "AWE" Piotr Janaska, and, where applicable, adjusted pricing.

5. Client Responsibilities

5.1. The client is responsible for providing a suitable venue with adequate space, infrastructure, and conditions for the agreed event setup, including but not limited to safe access for staff and equipment, appropriate indoor or outdoor area, and adherence to any maximum occupancy or safety limits.

5.2. The client must ensure that the venue provides essential utilities (such as stable electrical power and lighting) as specified in the technical or logistical requirements communicated by "AWE" Piotr Janaska. Any additional equipment, such as stage elements, sound systems, or special lighting not defined in the offer, may be subject to separate arrangements or costs.

5.3. The client agrees to cooperate on event scheduling and coordination, including granting timely access to the venue for setup, rehearsals, safety checks, and dismantling. Delays caused by the client or the venue that restrict proper setup may impact the final format or duration of the event, without entitlement to a refund.

5.4. The client is responsible for communicating all relevant venue rules, legal limitations (such as curfew or noise restrictions), and protection of minors where applicable. The client shall also ensure that participants and guests follow reasonable instructions given by the event staff concerning safety, equipment use, and event flow.

5.5. If the client engages other suppliers (e.g., catering, decorators, DJs), the client is responsible for coordinating such parties so that they do not obstruct the performance of services by "AWE" Piotr Janaska.

6. Payment Terms

6.1. Prices and fee structures for events are communicated individually in offers or agreements and may be based on fixed packages, custom configurations, or hybrid models depending on the complexity and scale of the project.

6.2. Unless otherwise specified, prices are quoted in Polish zloty (PLN) and are exclusive of any taxes or statutory charges that may apply under Polish law.

6.3. Accepted payment methods and detailed instructions (such as bank transfer details) are indicated on the invoice or in the booking confirmation. The client is responsible for any bank fees or transfer costs applied by their financial institution.

6.4. An advance payment or deposit may be required to secure the booking. The exact amount and due date of the deposit will be defined in the offer or invoice. The remaining balance is typically due on or before the date specified in the invoice, and in any case no later than the agreed event date, unless otherwise agreed in writing.

6.5. In the event of late or incomplete payment, "AWE" Piotr Janaska reserves the right to: (a) charge statutory interest for delay in accordance with applicable Polish law; (b) suspend or limit services until outstanding amounts are settled; and/or (c) treat the situation as a cancellation by the client in line with the cancellation provisions below.

7. Cancellations & Modifications

7.1. Any request to cancel or substantially modify a confirmed booking must be made in writing (e.g., by email) and is only effective upon written acknowledgment by "AWE" Piotr Janaska.

7.2. In the event of client-initiated cancellation, the following general principles apply unless otherwise specified in the individual offer or agreement:

  • (a) Early cancellation: If the client cancels sufficiently in advance, "AWE" Piotr Janaska may retain part or all of the deposit to cover administrative and preparatory costs already incurred.
  • (b) Short-notice cancellation: If cancellation occurs close to the event date and substantial resources have already been allocated, the client may be required to pay a higher proportion of the agreed fee, up to 100%, especially where third-party costs are non-refundable.

7.3. Specific deadlines, percentages, and conditions may be defined in the booking confirmation or proposal and, in case of conflict, take precedence over the general wording above.

7.4. If "AWE" Piotr Janaska must cancel or significantly modify an event due to force majeure (including but not limited to severe weather, natural disasters, pandemics, legal restrictions, sudden illness or accidents affecting key staff, or other circumstances beyond reasonable control), the company will inform the client as soon as possible and propose alternative dates or formats where feasible. In such cases, liability for damages is limited as described in the Liability section below.

7.5. If cancellation or material modification by "AWE" Piotr Janaska is not caused by force majeure and is within the company’s reasonable control, the client is entitled to a refund of any prepaid amounts related to the cancelled services. Further compensation is limited in accordance with the Liability provisions of these Terms and Conditions.

8. Liability & Insurance

8.1. "AWE" Piotr Janaska undertakes to perform services with due professional care, employing trained staff and using well-maintained equipment appropriate for mobile entertainment and casino-style experiences.

8.2. The liability of "AWE" Piotr Janaska for any direct damages arising from the performance of the contract, whether in contract, tort, or otherwise, is limited to the amount of the fee actually paid by the client for the specific event giving rise to the claim, unless mandatory provisions of Polish law require a higher limit.

8.3. "AWE" Piotr Janaska is not liable for indirect or consequential damages such as lost profits, missed business opportunities, reputational damage, or costs incurred by third parties, unless such exclusion is not permitted under mandatory law.

8.4. The company is not responsible for damages caused by improper use of equipment by guests, non-compliance with safety instructions, or the actions or omissions of third parties engaged directly by the client (e.g., venue operators, caterers, DJs).

8.5. Where applicable, "AWE" Piotr Janaska maintains liability insurance adequate for the nature of on-location events conducted in Poland. Details may be shared with the client upon reasonable request. The existence of such insurance does not extend the company’s liability beyond statutory limits.

9. Intellectual Property & Media Use

9.1. All event concepts, program formats, creative scenarios, visual materials, and documentation prepared by "AWE" Piotr Janaska remain the intellectual property of the company or its licensors, unless clearly transferred to the client in a separate written agreement.

9.2. The client is granted a non-exclusive, non-transferable right to use deliverables provided as part of the event solely for internal and private purposes, unless otherwise stated in writing. The client may not reproduce, resell, or commercially exploit event concepts or formats without prior written consent.

9.3. During events, photographs, video recordings, or other media may be created by or on behalf of "AWE" Piotr Janaska for documentation and portfolio purposes, subject to applicable privacy and image rights law. Where required, the client agrees to cooperate in obtaining necessary consents from participants or to inform them of the planned recordings.

9.4. With the client’s consent (which may be withdrawn at any time for future use), selected media from events may be used by "AWE" Piotr Janaska on its website, in presentations, or in marketing materials to showcase the style and quality of services.

9.5. If the client provides logos, brand assets, or proprietary materials to be used at the event, the client confirms that they own or have obtained all necessary rights and licenses and indemnifies "AWE" Piotr Janaska against any claims from third parties arising from such use.

10. Data Protection & Privacy

10.1. "AWE" Piotr Janaska processes personal data of clients and event participants in accordance with applicable data protection regulations, including the General Data Protection Regulation (GDPR) as implemented in Poland.

10.2. Personal data collected through the website (for example via the Booking and Contact Us pages), by email, or during event coordination is used solely for the purposes of handling inquiries, preparing offers, executing bookings, and maintaining necessary records for legal and accounting purposes.

10.3. Access to personal data is limited to individuals who need such access to perform their duties in relation to the provision of services. Appropriate technical and organizational measures are used to safeguard data against unauthorized access, loss, or misuse.

10.4. Clients have the right to request access to their personal data, rectification of inaccurate data, restriction of processing, or deletion of data where legally permitted. They also have the right to object to certain types of processing and, where applicable, to data portability.

11. Governing Law & Dispute Resolution

11.1. All contracts and legal relationships between "AWE" Piotr Janaska and the client, as well as these Terms and Conditions, are governed by and construed in accordance with the laws of the Republic of Poland, without regard to conflict-of-law rules.

11.2. The parties agree to make every reasonable effort to resolve any disagreements or disputes amicably through good-faith negotiations. The client is encouraged to first contact "AWE" Piotr Janaska via email at [email protected] or through the Contact Us page to seek clarification or propose a solution.

11.3. If an amicable resolution cannot be reached, any disputes arising out of or in connection with the agreement or these Terms and Conditions shall be submitted to the competent common courts in Poland, having jurisdiction under the applicable procedural rules.

11.4. Should any provision of these Terms and Conditions be declared invalid or unenforceable by a court or competent authority, the remaining provisions shall remain in full force and effect. The parties shall replace the invalid provision with a valid one that most closely reflects the original commercial intent.
